Welcome to InnovAssess. These Terms of Service ("Terms") govern your use of our medical assessment and treatment coordination services provided in connection with accident benefits claims. By accessing or utilizing our services, you agree to be bound by these Terms.
1. Services Provided
InnovAssess provides comprehensive services to facilitate medical assessments and treatment for individuals involved in motor vehicle accidents or other incidents covered by accident benefits insurance. Our services include:
Coordination of medical assessments (e.g., attendant care, psychological, physical).
Development of personalized treatment plans.
Preparation and submission of OCF-18 and other required forms to insurance companies.
Communication and liaison with insurance adjusters, legal representatives, and healthcare professionals.
Administrative management of your claim to ensure timely access to benefits.
2. Eligibility for Services
Our services are primarily available to individuals who have sustained injuries covered by accident benefits insurance in Canada. You must have an active accident benefits claim, and your services must be pre-approved or covered by your insurance provider.
3. Fees and Payment
InnovAssess' services are typically covered by your accident benefits insurance provider. We will bill your insurance company directly for all approved services. You will not be required to pay out-of-pocket for services that are covered by your accident benefits. In the event that a service is not covered by your insurance, we will inform your lawyer in advance, and they will have the option to proceed with the service on a private pay basis or decline. If you have Extended Health Care Benefits through your employer, treatment may need to be submitted to that insurer prior to submitting to the auto insurer for payment.
4. Your Responsibilities
To ensure the efficient and effective provision of services, you agree to:
Provide accurate and complete information regarding your medical history, claim details, and insurance coverage.
Attend all scheduled appointments for assessments and treatments.
Cooperate with our team and other healthcare professionals involved in your care.
Notify InnovAssess promptly of any changes to your contact information, insurance coverage, or claim status.
Adhere to the treatment plans developed in consultation with our team.
5. InnovAssess' Responsibilities
InnovAssess commits to:
Provide professional and high-quality assessment and treatment coordination services.
Act diligently in managing your claim and communicating with relevant parties.
Protect your personal and medical information in accordance with our Privacy Policy.
Keep you informed of the status of your claim, assessments, and treatment plans.
Strive for timely delivery of assessment reports and efficient processing of claims.
6. Confidentiality and Privacy
Your personal and medical information is treated with the utmost confidentiality. Our practices regarding the collection, use, disclosure, and protection of your information are detailed in our Privacy Policy, which is incorporated into these Terms by reference. By agreeing to these Terms, you also agree to the terms of our Privacy Policy.
7. Limitation of Liability
InnovAssess is dedicated to providing effective services. However, we are not responsible for:
Decisions made by your insurance company regarding coverage or denial of benefits.
Outcomes of legal proceedings related to your accident benefits claim.
Any delays caused by third parties, including insurance companies or other healthcare providers.
InnovAssess' liability for any claim arising out of or related to these Terms or the services provided shall be limited to the amount of fees received by InnovAssess for the specific services giving rise to the claim.
8. Termination of Services
InnovAssess reserves the right to terminate services if:
Your accident benefits coverage is exhausted or terminated.
You fail to comply with these Terms of Service.
There is a lack of cooperation or adherence to treatment plans.
Our services are no longer medically necessary or appropriate for your condition.
You may terminate our services at any time by providing written notice.
9. Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to its conflict of laws principles.
10. Dispute Resolution
Any disputes arising from these Terms or the services provided shall first be attempted to be resolved through good faith negotiation between the parties. If a resolution cannot be reached, the parties agree to explore mediation.
11. Amendments to Terms
InnovAssess reserves the right to update or modify these Terms of Service at any time. Any changes will be posted on our website with a revised effective date. Your continued use of our services after such modifications constitutes your acceptance of the revised Terms.
